Statement Insert materials due no more than 2 weeks, no less than 1 week prior to insertion date. Specs: 3.5" x 7.25" You are responsible for providing product that meets these specifications.
Package Insert materials due no more than 4 weeks, no less than 3 weeks prior to insertion date. Specs: 8.25" x 5.75" You are responsible for providing product that meets these specifications.
Receipt of product in advance of designated time frames may incur additional charges. All material must be marked with mailer, key codes, quantity, insertion date. Any materials arriving without proper identification will not be accepted.
If inserts are not received on time, insertion dates will not be guaranteed.
All material must be shipped prepaid.
All quantities provided are based on current and projected distribution for the program. We do not guarantee that these quantities will be met. We assume no liability for pieces that are not distributed on time due to fluctuations in sales.
List Owner does not offer right of 1st refusal.
Terms & Conditions: Payment is due 30 days after the mail date. This purchase order/acknowledgement copy provides instructions for the proper execution by the broker/mailer as well as terms mutually acceptable to all parties in this transaction. Unless IMS List Management receives a written notification within two days of receipt of this order acknowledgement, it is assumed that the corrections listed are accepted by broker/mailer and order will be fulfilled as such.
List/Insert Program Owner: Neither IMS List Management nor the list owner is liable for any damages or loss sustained through use of this list, or for any special or consequential damages, and in no event shall liability exceed the price of the list.
List/Insert Program User: All orders are subject to final approval of list/insert program owner. List/insert program owner will not be held liable for any damage resulting from accepted delays in delivery. We believe the information stated to be accurate, but neither the list/insert program owner nor IMS List Management can guarantee the outcome of the mailing. In addition to any other payment required hereunder, the mailer will bear the burden of all sales and use or similar taxes as may be imposed with respect to the transactions hereunder. Mailers shall pay all expenses incurred for the enforcement of terms and conditions of orders including, but not limited to, cost of collection, litigation and reasonable attorney's fees.
Mailer Guarantee: Mailer guarantees full payment on orders if cancelled after insertion date. Mailer guarantees that cancellations made with less than 90 days notice from insertions date will be paid in full. Mailer guarantees that cancellations made prior to 90 days from insertion date will incur a $100 processing fee.
